1. Scope of Application

These Terms & Conditions apply to the use of this website and to all services offered by Somatic Marbella, a self‑employed practitioner (autónoma) based in Marbella, Spain.

By accessing this website, requesting information, or booking a session, you agree to be bound by these Terms & Conditions.

2. Nature of Services

Somatic Marbella offers non‑medical somatic bodywork and massage services intended to support relaxation, body awareness, and nervous system regulation.

The services provided:

are not medical or clinical treatments,
do not replace medical, psychological, or psychiatric care,
and are offered exclusively for well‑being, self‑regulation, and personal support.

Clients remain fully responsible for their own physical and mental health and are encouraged to seek appropriate medical care when needed.

3. Appointments & Booking

All sessions are offered by appointment only.

Appointments may be requested via email or through booking tools provided on the website.
An appointment is considered confirmed only after explicit confirmation by Somatic Marbella.

4. Cancellation & Rescheduling Policy

Appointments are reserved exclusively for you.

If you need to cancel or reschedule a session, please provide at least 24 hours’ notice.

Cancellations made less than 24 hours before the scheduled session time, as well as no‑shows, may be charged in full, unless otherwise agreed in exceptional circumstances.

This policy exists to honour the time, preparation, and space required for each session and for each body.

5. Client Responsibility & Health Information

Clients are responsible for informing the practitioner prior to the session of any information that may be relevant, including but not limited to:

injuries or physical limitations,
medical conditions,
pregnancy,
or any circumstances that could affect the session.

Somatic Marbella cannot be held liable for consequences arising from withheld, incomplete, or incorrect information.

6. Consent & Boundaries

All sessions are conducted with clear communication, mutual respect, and attention to personal boundaries.

Clients may pause, modify, or stop a session at any time.
Any inappropriate, disrespectful, or boundary‑crossing behaviour will result in immediate termination of the session without refund.

7. Payment

Prices, payment terms, and accepted payment methods are communicated prior to the session or at the time of booking.

All prices are subject to applicable Spanish tax regulations.

8. Intellectual Property

All content on this website, including texts, images, and design elements, is the intellectual property of Somatic Marbella, unless otherwise stated.

Any reproduction, distribution, or use without prior written consent is prohibited.

9. Limitation of Liability

Somatic Marbella is not liable for:

indirect or consequential damages,
unmet personal expectations,
or outcomes beyond the clearly described scope of the services offered.

Nothing in these Terms & Conditions limits liability where such limitation would be unlawful under Spanish law.

10. Data Protection

Personal data is processed in accordance with the Privacy Policy, the General Data Protection Regulation (GDPR), and the Spanish LOPDGDD.

11. Governing Law & Jurisdiction

These Terms & Conditions are governed by Spanish law.

Any disputes shall be subject to the jurisdiction of the courts in Spain, unless mandatory consumer protection regulations provide otherwise.

12. Changes to These Terms

Somatic Marbella reserves the right to update or modify these Terms & Conditions when necessary.
